Terms and Conditions of Sale

Preamble

The Acta Boardsports brand is owned by SDG Distribution, a simplified joint-stock company (SAS) with share capital of 37,000 euros, whose registered office is located at 114 rue des Vanniers, 40150 Soorts-Hossegor, France (RCS Dax B 500 510 961).

Article 1 – Scope

These terms and conditions of sale govern all sales on www.acta-boardsports.com. The purchase of a product constitutes full and unreserved acceptance of these terms. The terms may be modified; the version in effect at the time of the order applies.

Article 2 – Customer account

  • Opening and using the site is free of charge
  • Access reserved for personal use
  • The customer must provide accurate and complete information
  • The customer is responsible for the confidentiality of their login details

Article 3 – Intellectual property

The site, its content, and all elements comprising it are creations for which SDG Distribution holds all intellectual property rights. Any commercial use is prohibited without prior authorization.

Article 4 – Prices

  • Prices in euros including tax for mainland European Union
  • Prices excluding tax for deliveries outside the EU
  • The customer is responsible for any applicable taxes and customs duties
  • Prices may be changed; the rate applied is the one in effect when the order is registered
  • Discount vouchers cannot be combined

Article 5 – Orders

  • Confirming the order (double-click + authentication) constitutes conclusion of the contract
  • A confirmation email is sent automatically
  • Tracking is available under "My Orders"
  • The customer is responsible for errors in the information entered
  • If a product is unavailable: automatic cancellation and refund if already charged

Article 6 – Payment

Accepted methods

  • Credit card (Visa, Mastercard, American Express, Bancontact)
  • PayPal
  • Apple Pay / Shop Pay
  • Installment payment with Klarna (subject to approval)

Article 7 – Delivery

The package is handed over to the carrier within a maximum of 24 business hours after order confirmation. Delivery time within mainland France: 24 to 72 business hours. The customer is notified by email and can track their order from their customer account.

Delivery is made to the doorstep or ground floor. The customer must note any reservations on the delivery slip. In the event of a damaged package, contact customer service as soon as possible.

Article 8 – Transfer of ownership

Ownership of the purchased goods transfers only upon actual delivery.

Article 9 – Right of withdrawal

In accordance with Article L.221-18 of the French Consumer Code, you have a period of 14 days from receipt of your order to exercise your right of withdrawal, without justification or penalty.

Returns should preferably be sent by registered mail, within 14 days of sending your withdrawal notice, at the customer's expense. The product must be returned in perfect resalable condition, unused, and not assembled.

The refund is made within a maximum of 14 days from receipt of the return or proof of shipment. In the case of a partial return, only the price of the returned items is refunded (excluding outbound shipping costs).

Article 10 – Liability and warranties

SDG Distribution is liable for the products sold in accordance with applicable regulations.

Non-conformity

The consumer has a period of 2 years from delivery of the goods to take action in the event of a lack of conformity. During the first 6 months, the consumer is not required to prove the existence of the defect.

Hidden defects

SDG Distribution guarantees against hidden defects that render the product unfit for use. The customer has 2 years from discovery of the defect to take action.

Article 11 – Protection of personal data

SDG Distribution is subject to the GDPR (2016/679) and French law no. 78-17 of 6 January 1978. The data collected (name, address, phone number, email, banking information, IP address) is necessary for order management.

You have the right to access, modify, object to, port, restrict, and delete your data. To exercise these rights:

Article 13 – Disputes, applicable law and mediation

These terms and conditions are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action.

Failing an amicable resolution, disputes fall under the jurisdiction of the courts of the customer's place of residence at the time the contract was concluded.

Article 14 – Installment payment with Klarna

ACTA Boardsports offers installment payment via Klarna, subject to approval of your application by Klarna. This service allows you to pay for your order in several installments according to the option shown at the time of payment.

How it works

  • Service reserved for adult private individuals, subject to eligibility and Klarna's approval.
  • The order amount must fall within the limits set by Klarna.
  • The first installment is charged upon order confirmation; subsequent ones follow the schedule shown before payment.
  • Detailed terms (number of installments, any fees, accepted payment methods) are shown in the Klarna interface at checkout.

Provider

The service is provided by Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden. Use of Klarna is subject to Klarna's terms and conditions, available at www.klarna.com/fr. The data required to assess the application is processed by Klarna in accordance with its privacy policy.

Withdrawal and disputes

The right of withdrawal provided for in Article 9 of these terms applies. Any question relating to Klarna financing (installments, charges) should be addressed directly to Klarna via the app or its customer service.
